Terms of Use

These Terms govern orders for tech-pack and garment-development services offered under the name George Darks through this website. By placing an order, you agree to these Terms and the Refund Policy, subject to any rights that apply to you under law.

1. Services

George Darks provides digital design and garment-development services, including:

  • Starter, Complete and Production Ready tech-pack packages.
  • Technical flats, measurements and specifications, as described in the selected package.
  • Production Ready support, including manufacturer introductions, quote comparison support and sample feedback.
  • Other custom work if agreed with you in writing.

Deliverables are supplied digitally. Package scope is the description and features shown at checkout when you place your order. Prices shown cover one standard garment style; complex garments or work outside the listed scope may need a custom quote.

2. Orders & Payments

  • Payment is made through Stripe Checkout for the selected package and any add-ons chosen before payment.
  • Prices are shown and charged in GBP unless checkout states otherwise.
  • Full payment is due before work begins.
  • We begin work after payment has been received and your project brief has been confirmed.
  • If payment cannot be completed, we may pause the order until the payment issue is resolved.

Your bank or payment provider may apply its own currency conversion or transaction fees.

3. Delivery Timelines

  • The estimated turnaround is 7–10 working days after your brief and required references are confirmed.
  • Production Ready receives priority attention, but this does not guarantee a shorter delivery period.
  • We’ll let you know if something affects the expected timing.
  • The schedule pauses while we’re waiting for information, files or feedback needed from you.

Delivery dates are estimates unless we confirm a specific date in writing.

4. Revisions

Revision allowances depend on the selected package:

  • Starter: 1 revision round.
  • Complete: 2 revision rounds.
  • Production Ready: 3 tech-pack revision rounds and 1 sample-feedback round.

A revision round means one consolidated set of feedback followed by an updated version. Revisions apply to the agreed garment and design direction. A new garment, substantial change in direction, or work outside the package may require a separate quote, which we’ll agree with you before starting.

5. Client Responsibilities

You agree to:

  • Provide accurate project information and the references needed for the work.
  • Review drafts and give clear, consolidated feedback.
  • Tell us about relevant requirements, deadlines and changes to the brief.
  • Ensure you have permission to use any sketches, logos, artwork, images or other material you provide.

You are responsible for checking that your materials and intended product comply with applicable laws and third-party rights. We may refuse work that appears unlawful or uses material you do not have permission to use.

6. Intellectual Property

You keep the rights to the designs, logos, artwork and other materials you provide. You give us permission to use them as needed to complete your project.

Once the project has been paid for in full and the final files have been delivered, you may use the final project-specific tech-pack materials for your garment development, sampling and manufacturing. Our pre-existing methods, know-how, reusable templates and tools remain ours. Third-party materials remain subject to their owners’ terms.

7. Use of References & Third-Party Materials

References, fabric or trim examples, mock-ups and other visual materials may be included to communicate a design or specification. They are not necessarily supplied as physical goods or licensed assets.

Any third-party material remains subject to its original rights and licence terms. You are responsible for obtaining any additional permissions needed for your use of materials you provide or select.

8. Refunds

Refund eligibility under our voluntary satisfaction guarantee is explained in the Refund Policy. Please review it before ordering.

Nothing in these Terms or the Refund Policy removes rights or remedies that apply to you under law.

9. Chargebacks & Payment Disputes

If you have a concern about a payment or project, please raise it with us in the project chat so we can try to resolve it.

If a payment dispute is opened, we may pause work that has not yet been completed while the payment is reviewed, and we may provide relevant order and project records to Stripe or your payment provider. Nothing in these Terms prevents you from contacting your card issuer or exercising any rights you have.

10. Cancellation

You may contact us in the project chat to cancel an order. Refunds under our voluntary guarantee are handled under the Refund Policy.

If you are a UK consumer buying online, you may also have a statutory right to cancel a service contract within 14 days of entering into it. That period is separate from the project-approval dates in the Refund Policy. If you ask us to begin work during that period, we’ll obtain any required express request and acknowledgment before we start. Nothing in these Terms treats payment alone as that request or acknowledgment.

11. Client Inactivity

We need your information and feedback to progress the project. If you have not responded or supplied requested information for 40 consecutive calendar days, we may contact you in the project chat to check whether you want to continue.

If we do not hear from you, we may close the project and send you the work completed so far. The delivery schedule pauses while we wait for your response. Refund requests will be considered under the Refund Policy and any applicable rights.

12. Manufacturer Introductions & Optional Support

Manufacturer introductions and Production Ready support are intended to help you explore production options. We do not control manufacturers’ availability, quotes, decisions, production quality or delivery times, and an introduction does not guarantee that a manufacturer will accept or complete your order.

You are responsible for deciding whether to work with a manufacturer and for agreeing production terms directly with them. We do not provide legal, regulatory or trademark clearance.

13. Limitation of Liability

We remain responsible for providing our services with reasonable care and skill. Nothing in these Terms limits liability or rights that cannot legally be limited.

We are not responsible for independent decisions or work by manufacturers and other third parties. Any other limitation of liability would be subject to applicable law.

14. Service Standards & Outcomes

We’ll prepare the agreed work with reasonable care and skill. A tech pack is intended to communicate garment details to a manufacturer, but it cannot guarantee how a third party will interpret it or what a sample or finished product will be like.

You and your manufacturer should review the tech pack and sample for fit, construction, materials, labelling and any product or market requirements before production.

15. Termination

We may pause or end a project if we reasonably believe it involves fraud, unlawful activity, abusive conduct, or a serious breach of these Terms.

If we end a project for a reason that is not your breach, we’ll review any payment for work not yet provided in line with the Refund Policy and applicable law.

16. Modifications

We may update these Terms as the service changes. The version available when you place your order will generally apply to that order, unless a change is required by law or we agree otherwise with you.
